Burlington Man Indicted in Connection to Fatal Pedestrian Accident Last August

A Burlington man has been indicted on charges in connection with the , Middlesex District Attorney Gerry Leone informed the public today.

According to a release from the DA's office, Anthony Manfredi, 49, of Burlington, was indicted by a Middlesex County grand jury on charges of felony motor vehicle homicide and operating under the influence of liquor, second offense.

Manfredi will be arraigned in Middlesex Superior Court in Woburn on Tuesday, Jan. 31 at 9 am.

"We allege that this defendant drove his vehicle negligently while under the influence of alcohol, resulting in the death of a pedestrian," District Attorney Leone said. "Any time you get behind the wheel while under the influence of alcohol, you greatly heighten the risk of danger to yourself and others.  Here, we allege the defendant displayed obvious signs of significant impairment and this, coupled with his negligent driving, caused the death of the victim."

According to the release, at approximately 8:10 p.m. on August 14 of last year, responded to the intersection of Cambridge Street and Olympia Way on a report of a motor vehicle striking and injuring a pedestrian.  Upon arrival, officers observed Burlington Fire and Rescue personnel rending aid to the victim, Daniel Jalbert, 51, who was lying on the pavement next to a blue Chevy Tahoe with visible front-end damage.  The victim was transported to where he was pronounced dead.

Also on scene, authorities located the defendant who was the alleged operator of the Chevy Tahoe.  While speaking with the defendant, officers observed that he was unsteady on his feet, his words were slurred and there was a strong odor of alcohol coming from his mouth.  Subsequently, the defendant failed several field sobriety tests and was placed under arrest.

During an arraignment at Woburn District Court on August 15, Leone's office stated that following the accident Manfredi blew a 0.26 in a Breathalyzer test, over three times the legal limit.

During the arraignment Judge Tobin Harvey ordered Manfredi held on $5,000 cash bail with the conditions that if he posts bail he is ordered not to drive during the pendency of the case, ordered to refrain from the use of alcohol and subject to random screenings, and ordered to have no contract with the witnesses in the case, the DA's release explains.

The defendant was indicted by a Middlesex County grand jury on January 24, 2012.

These charges are allegations and the defendant is presumed innocent until proven guilty.
